FUNDS AVAILABILITY POLICY FOR BUSINESS TRANSACTION ACCOUNTS

Our general policy is to make funds from your deposits available to you on the same business day as the day we receive your deposit. At that time, you may withdraw the funds in cash and we will use the funds to pay checks and debits that you have written or authorized. However, in some instances certain delays on the availability of funds may be applied. During the delay, you may not withdraw the funds in cash and we will not use the funds to pay checks or debits that you have written or authorized.

Determining the Availabilty of a Deposit

For determining the availability of your deposits, every banking day is a business day except Saturday, Sunday, and federal holidays. If you make a deposit during regular business hours on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit on a day that the Credit Union is not open, the Credit Union will consider that the deposit was made on the next business day that we are open. The availability depends on the type of deposit which is outlined below.

Next Day Availability

Funds from the following deposits are available on the next business day after the day of your deposit:
  • U.S. Treasury Checks
  • State and local government checks
  • Cashier's, certified, and teller's checks
  • " Federal Reserve Bank checks, Federal Home Loan Bank checks and postal money orders


Longer Delays May Apply In some cases, the Credit Union will not make all of the funds that you deposit by check available to you on the first business day after the business day of your deposit. Funds will generally be available no later than the second business day after the business day of your deposit of a local check and the fifth business day after the business day of your deposit of your non-local check. However, the first $100 of your deposit will be available on the first business day after the business day of your deposit. Funds you deposit by check may be delayed for longer periods under the following circumstances: (a) the Credit Union believes a check you deposit will not be paid; (b) your deposit checks total more than $5,000 on any one day; (c) you re-deposit a check that has been returned, unpaid; (d) you have overdrawn your account repeatedly in the last six months; or, (e) there is an emergency, such as failure of communications or computer equipment.

Special Rules for New Accounts

If you are a new member, the following special rules will apply during the first 30 days your account is open. (1) Funds from electronic direct deposit into your account will be available on the day the Credit Union receives the deposit. (2) Funds deposited by wire transfer and the first $5,000 of a day's total deposits of cashier, certified, teller, traveler, Federal, State, and local government checks will be available on the first business day after the day of your deposit. The excess over $5,000 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a U.S. Treasury check) is not made at Northern Star Credit Union, the first $5,000 will not be available until the second business day after the day of your deposit. (3) Funds from all other check deposits will be available on the ninth business day after the day of your deposit.

Deposits and Automated Teller Machines

Deposits will not be accepted at any proprietary automated teller machines (ATM's).

Additional Information

In an instance where funds have been made available to you, and you have withdrawn them, you will still be responsible for any problems with a deposit, such as checks that were deposited and returned unpaid.



ELECTRONIC FUNDS TRANSFERS' DISCLOSURE

This disclosure governs any Electronic Funds Transfer made by you, or anyone authorized by you through your Account(s) at Northern Star Credit Union. The Electronic Funds Transfers we are capable of handling are indicated below, some of which may not apply to your account. Please read this disclosure carefully because it tells you your rights and obligations for these transactions.

Business Platinum

Check card means only your VISA Business Platinum Check card. "You", "your" and "yours" refer to each person to whom the card is issued or to any-one you authorized to use the card. "We", "us" and "ours" refer to "Northern Star Credit Union." Account(s) shall refer to your checking account, savings account or other accounts that may be accessed through the use of your card.

Limits and Rules on Transfers for Check Cards

You may access your account(s) by ATM and/or Point of Sale terminals by using your Check Card and personal identification number to:
  • Make cash withdrawals up to $500.00 per calendar day.
  • Make purchases with your Check Card at a VISA accepting merchant up to the available balance in your checking account(s).
  • Transfer funds from savings/checking account(s).
  • Verify the account balance of your savings/checking account(s) with your Check Card



Limitations on Frequency of Transfers

In addition to those limitations of transfers elsewhere described, the following limitations apply: During the statement period, you may not make more than six withdrawals or transfers from your savings account to another credit union account of yours, or to a third party by means of a preauthorized, automatic, or telephone transfer. No more than three of the six transfers may be made by check, check card (if applicable) or similar order to a third party. If you exceed the transfer limitations set forth in any statement period, your account will be subject to closure by the credit union.

Charges for Electronic Fund Transfers
  • We do not charge for direct deposits to any type of account
  • We do not charge for preauthorized withdrawals from any type of account
  • Except as indicated elsewhere, we do not charge for electronic fund transfer


Pre-authorized Electronic Transfers

In addition to using the ATM personally, you can pre-authorize the Credit Union to make transfers electronically. These include pre-authorized payments such as insurance. Pre-authorized transfers authorizations must be in writing. Although you can call the Credit Union for information about the transfer, your only documentation of the transfer will be an entry on your periodic statement.

Stop Payment Procedures and Notice of Varying Amounts
  • Right to stop payment and procedure
    • If you have told us in advance to make regular payments, from your account, you can stop any of these payments by doing the following: visiting one of our branches in time for us to process your request three business days or more before the payment is scheduled to be made.
  • Stop payments on Check card
    • You acknowledge and agree that you may not stop payment on any transaction initiated through your use of the check card or PIN.
Liability: If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we may be liable for your losses or damages if you prove the failure was caused by our willful misconduct or gross negligence and cause you actual damages. We will not be liable in the following circumstances:
  1. If, through no fault of ours, you do not have enough money in your account to make the transfers
  2. If the automated teller machine where you are making the transfer does not have enough cash
  3. If the terminal or system was not working properly and you knew about the breakdown when you started the transfer
  4. If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions we have taken
  5. There may be other exceptions stated in our agreement with you


Disclosure of Account Information to Third Parties

We may disclose information to third parties about your account or the transfer(s) you make:
  1. Where it is necessary for completing the transfers
  2. In order to verify the existence and condition of your account for the third party, such as a credit bureau or merchant
  3. In order to comply with government agency or court orders
  4. If you give us written permission
  5. As otherwise required by law
Unauthorized Transfers

Notify us AT ONCE if you believe your card and/or pin number has been lost or stolen. The best way to minimize your possible losses is to telephone, although you may tell us in person or in writing. If your Visa Check Card is lost or stolen, your liability for authorized Visa transactions with the card, other than transactions at an ATM, is zero ($0) providing you notifying us within two business days after discovering that your card is lost or stolen (a maximum of fifty ($50) if you notify us after two business days). Your liability for other assertions of unauthorized Visa transactions, other than unauthorized use involving an ATM, is a maximum of $50. The provisions of this paragraph do not apply if you were grossly negligent or fraudulent in the handling of your account or card. If we determine that the unauthorized use situation involving your Visa Check Card is not covered under the previous paragraph or if the unauthorized use involves your ATM card or other electronic fund transfer service, your liability is determined under this paragraph. If you believe your Visa Check Card has been lost or stolen, and you tell us within two business days after you learn of the loss or theft, your loss can be no more than $50. If you fail to notify us within two business days after you learn of the loss or theft of your card, and we can prove that we could have prevented the loss had we been notified you are liable up to $500. If your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed, you will be liable for the entire loss. If extenuating circumstances kept you from notifying us, we will extend the time periods. If you believe your card has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call or write us immediately.

Error Resolution

In case of error or questions about your electronic transfers, or if you think that your statement or receipt is wrong, or if you need more information about a transfer listed on the statement or receipt, call or write us at the telephone number or address listed in this disclosure as soon as possible. We must hear from you no later than 30 days after we sent you the FIRST statement on which the problem or error appeared.
  1. Provide your name and account number
  2. Describe the error or the transfer you are unsure about, and explain why you believe it is an error or why you need more information
  3. Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your question in writing within 10 business days.
We will determine whether an error occurred and will correct any error as soon as reasonably possible. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may disregard your inquiry. After we complete our investigation, if we decide that there was no error, we will send you a written explanation.

Business Days

Our business days are Monday through Friday, excluding federal holidays.

Foreign Currency

In the event that the use of the account involves foreign currency, your account will be billed/credited at the highest rate of conversion to U.S. dollars on the date the transaction is processed through our system. We are not liable to you for the fluctuation in the exchange rate occurring between the date of sale or payment and the date of conversion. Any charges paid by us to exchange processors will be applied to the transaction.

Attorney Fees

In the event we have to file a lawsuit to collect what you owe us, you will be responsible for our reasonable expenses at collection, including court cost and attorney fees.

USING THE CARD

You acknowledge and agree that any card or PIN may be used for business purposes only and may not be used for personal, household, or family purposes. The business owner agrees to implement reasonable measures to ensure that any card or PIN is used for business purposes only.

Any financial service provided by Northern Star Credit Union may be used for any transaction permitted by law. I agree that illegal use of any financial service will be deemed an action of default and/or breach of contract and such service and/or other related services may be terminated at Northern Star Credit Union's discretion. I further agree, should illegal use occur, to waive the right to use Northern Star Credit Union for such illegal activity directly or indirectly related to it. I also agree to indemnify and hold Northern Star Credit Union harmless from any suits or other legal action or liability, directly or indirectly, resulting from such illegal use.

The business owner agrees to be unconditionally liable for use of the services, whether authorized or unauthorized, whether used by authorized signers or other persons, and whether arising from cards or PINs lost or stolen. You agree to telephone us AT ONCE at the telephone number appearing below if you believe your card or PIN has been lost or stolen or you know of or suspect unauthorized use of the services.



PRIVACY NOTICE

We collect only the personal information that is necessary to provide competitive financial products and services. We collect information about you from the following sources:
  1. Information from applications and other forms you submit to us
  2. Information we obtain when verifying the information you provide on an application
  3. Information about your transactions with us or others
  4. Information we receive from credit bureaus
We may share information about you to administer the products and services we provide or when permitted or required by law. These disclosures typically include information to process your transactions on your behalf, conduct the operations of our credit union, and follow your instructions as you authorize, protect you against fraud, or protect the security of our financial records.
We may disclose information we collect, as described above, to companies that perform marketing services on our behalf. These businesses follow strict confidentiality requirements. Under no circumstances do we authorize these businesses to charge your account without your express consent. We do not sell member information to telemarketing firms. We maintain strong security controls to ensure that your information in our files and computers is protected. Where appropriate, we use security coding techniques to protect against unauthorized access to personal records, ensure accuracy and integrity of communications and transactions, and protect member confidentiality. You will always have access to your information to review for accuracy. If you terminate your membership with us, we will not share information we have collected about you, except as permitted or required by law.

Sharing Information with Third Party Service Providers

In order for us to conduct our operations, including servicing your account or processing your transactions, we need to share information with our service providers, including: data processing companies, check, ATM and other payment processing companies, payment networks, and loan service providers with whom we have joint marketing agreements. These service providers act on our behalf and have agreed in writing to keep the member information we provide to them confidential. We share the following categories of information to third party service providers depending on the specific services provided:
  • Personal information (name, address, and account number)
  • Account information (type of accounts, account balances, and transaction history)
  • Transaction information (dates, amounts, locations, and type of transaction)
